I hereby acknowledge that I am voluntarily participating in the use of an efoil, which is owned and operated by DS Foils, located in the province of Saskatchewan. I understand that the use of an efoil involves certain risks, including but not limited to, the risk of injury or death, and that these risks cannot be eliminated.
I hereby acknowledge that I am physically and mentally capable of using the efoil, and that I have not been advised otherwise by a medical professional. I agree to follow all safety guidelines and instructions provided by DS Foils regarding the use of the efoil.
In consideration of being allowed to use the efoil, I hereby release, waive, discharge, and covenant not to sue DS Foils, its owners, officers, employees, agents, and affiliates (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Releasees or otherwise, while participating in the use of the efoil.
I understand that this waiver and release of liability includes any claims based on the negligence, action, or inaction of any of the Releasees, including but not limited to, negligence in the design, manufacture, maintenance, selection, or adjustment of the efoil.
I hereby agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost they may incur arising out of or related to my use of the efoil.
I understand that this waiver and release of liability is intended to be as broad and inclusive as permitted by the laws of the province of Saskatchewan and agree that if any portion of this agreement is held invalid, the remainder of the agreement will continue in full legal force and effect.
I have read this waiver and release of liability form, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement, assurance, or guarantee being made to me.
